Capability validation in 802.11g

Hi,
There is also one another condition where it should be set, as mentioned in standard.
From 802.11g 2003 standard:
The Barker_Preamble_Mode bit shall be set to 1 by the ERP Information Element sender if one or more associated NonERP STAs are not short preamble capable as indicated in their Capability Information
field, or if the ERP Information Element senders dot11ShortPreambleOptionImplemented MIB
variable is set to false.
And this condition is not realised by Cisco i.e if we set long preamble only ,with no stations associated the barker bit is not set in beacon.
Can you please explain this anamoly or is this a defect in cisco implementation
