lower band instead of upper band outdoors

hi everybody,
According to FCC rules we can use the lower UNII band only indoors while upper UNII band outdoors. Therefore, we know higher frequency higher loss, hence, why was it defined in the contrary?
I guess it'd be more useful if the frequency were lower in outdoor environments, because the distance between APs would increase significantly, am I right?

I have NO IDEA if the wonderfully knowledgeable folks at the FCC bamboozled us with the 802.11a bands or not. Maybe we'll never know.
But I do know the RF characteristics between the two 5.8 Ghz bands (lower and upper) is the same. You will not notice any real difference between the two in regards to range or penetration.
