The FCC changed the requirement for devices to have vendor supplied antennas. Now, all you have to do is have the same gain or lower for an antenna to be within the restrictions of the certification. If you fall outside those restrictions then it is up to the "professional installer" to make sure the device remains within the listed FCC laws regarding operating in that spectrum. This does not mean you can have a 1W-capable AP using a 17dB gain antenna but it does mean you have some flexibility in what solutions you chose to deploy, as long as you remain below the max operating limits.

Also, for those of you with Ham operator status, you have additional license to exceed the FCC operating restrictions placed on non-Ham intentional radiators BUT you know the laws regarding that (if you truly are a ham operator) and should understand what modifications you're able to implement.

Criss Hyde should be able to update us on exactly what the FCC now states as "certified systems" and "professional installers" and the new operating requirements for ISM/UNII devices in the 2.4GHz and 5GHz spectrums.
